Repeals section 586-10.5, Hawaii Revised Statutes, which required mandatory referrals to the Department of Human Services in domestic abuse cases involving minors or incapacitated persons.

Eliminates the requirement for family courts to notify the Department of Human Services when a temporary restraining order is granted in cases alleging domestic abuse involving a minor or incapacitated family or household member.

Removes the requirement for the Department of Human Services to provide written reports to the family court on the disposition of referrals in domestic abuse cases.

Allows judges to continue exercising their discretion to refer cases to the Department of Human Services when they determine investigation is warranted to ensure family safety.

Takes effect upon approval and does not affect rights, duties, penalties, or proceedings that began before the effective date.
