Prohibits counties from enacting ordinances that prohibit a person from sitting or lying by the roadside of public lands, in accordance with Article IX, Section 10 of the Hawaii State Constitution.

Allows county officials to remove a person from a roadside only if conditions exist that would place the person at risk of immediate bodily injury.

Prohibits officials from engaging in unprovoked assault, threats, or harassment when removing a person from a roadside.

Defines "by the roadside" to include sidewalks as defined in section 291C-1 of Hawaii Revised Statutes.

Takes effect upon approval and adds new section to Chapter 46, Part V of Hawaii Revised Statutes.
