Requires assessment of patients admitted to emergency departments or hospitalized on an emergency basis who are diagnosed with mental illness or severe substance use disorder and found to lack decisional capacity to determine whether a surrogate or guardian should be appointed to make health care decisions.

Amends Section 334-59 of Hawaii Revised Statutes to clarify that psychiatrists or advanced practice registered nurses with prescriptive authority and psychiatric specialization certification can perform emergency examinations and direct emergency hospitalization.

Ensures patients have the right to contact a guardian, family member, reciprocal beneficiary, adult friend, or attorney immediately upon admission, with family notification required unless the adult patient requests otherwise.

Effective July 1, 2060.
