H.B. 806 - Overtime Limitations Summary

• Prohibits health care employers from requiring nurses, nurse aides, and respiratory therapists to work beyond a predetermined and regularly scheduled shift or beyond 80 hours in a 14-day period without employee consent.

• Requires health care employers to provide at least 10 consecutive hours of off-duty time immediately following completion of a scheduled shift for nurses, nurse aides, and respiratory therapists.

• Allows health care workers to refuse overtime assignments if they determine the overtime would jeopardize patient or employee safety.

• Exempts certain situations from overtime restrictions including unforeseen emergencies, voluntary overtime, on-call agreements, medical transport aircraft work, school-sponsored special events, and weekend shift contracts with specific pay and benefit requirements.

• Takes effect January 1, 2022 and does not affect rights, duties, or proceedings that matured before its effective date.
