H.B. 977 Summary

• Extends the nursing facility sustainability program by amending the repeal date from June 30, 2021 to December 31, 2023, with certain provisions extending to June 30, 2024.

• Changes the revenue distribution requirements to allocate at least 88% of nursing facility sustainability fee revenues to match federal Medicaid funds for increasing payments to private nursing facilities or quality incentives, with 12% available for other departmental purposes.

• Modifies the enhanced capitation rates period from state fiscal years 2019-2020 and 2020-2021 to July 1 through December 31, 2021, and calendar years 2022 and 2023.

• Removes a provision that would discontinue fee collection if the department reduces nursing facility funding below the June 30, 2020 state appropriation level.

• Appropriates $15,000,000 or so much as necessary from the special fund for fiscal years 2021-2022 and 2022-2023 for uses consistent with the program.
