Department of Commerce and Consumer Affairs requested to convene a working group to address governance issues in Puna District housing subdivisions that lack homeowner associations for maintaining shared roads and infrastructure.

Working group tasked with reviewing condominium association procedures and administrative rules that could be applied to establish a governance framework for these subdivisions, including bylaws for notice, voting, and governance.

Working group membership includes representatives from the House and Senate representing the affected district, Hawaii County Mayor's office, Department of Commerce and Consumer Affairs Real Estate Branch, Hawaii Council of Community Associations, Community Associations Institute Hawaii Chapter, and two community stakeholders.

Working group required to submit findings, recommendations, and any proposed legislation to the Legislature no later than twenty days before the 2023 Regular Session convening.

Resolution addresses decades-old problems stemming from 1960s subdivisions approved without governance entities, resulting in deteriorated roads that have delayed emergency services and caused disputes requiring expensive litigation.
