S.B. 1027 Summary

• Redesignates the industrial hemp special fund as the hemp special fund and authorizes the department of agriculture to use funds for hemp monitoring, transportation enforcement, and regulatory duties established under Act 14, Session Laws of Hawaii 2020.

• Expands chapter 328G to regulate both hemp processing and hemp product manufacturing (previously focused only on processors), establishing a registration system administered by the department of health.

• Prohibits sale of hemp products infused into food, synthetic cannabinoids, products designed for respiratory inhalation, and hemp leaf or floral material for smoking; requires hemp products to be in tablet, capsule, powder, softgel, gelcap, gummy, or liquid form.

• Requires registrants to maintain enclosed indoor facilities, obtain federal licenses, provide contact information and facility details, and allow department inspections; establishes civil penalties of up to $10,000 per violation.

• Makes Act 14 permanent by removing its June 30, 2022 repeal date; bill effective July 1, 2050.
