S.B. 1147 Summary

• Makes unlawful the sale of flavored tobacco products and e-liquid, the mislabeling of nicotine-containing e-liquid products as nicotine-free, and the sale of tobacco products outside of in-person retail exchanges (prohibits mail, curbside, and delivery sales)

• Establishes unlawful shipment of tobacco products as an offense (class C felony for $10,000+ value, misdemeanor for less) when shipped to non-licensed entities in Hawaii

• Includes electronic smoking devices and e-liquid within the definition of "tobacco products" for tax and licensing purposes, subjecting them to excise tax on tobacco products

• Requires retailers selling e-liquid or electronic smoking devices to obtain a retail tobacco permit and specifies permit type; increases license fees for wholesalers and dealers of cigarettes and tobacco products (fee amounts blank in bill)
