SB2032 - Hawaii Genetic Information Privacy Act

• Establishes the Hawaii Genetic Information Privacy Act to regulate direct-to-consumer genetic testing companies and protect consumer genetic data privacy.

• Requires direct-to-consumer genetic testing companies to provide clear privacy notices, obtain express consent for data collection and use, and implement comprehensive security programs to protect genetic data.

• Prohibits disclosure of consumer genetic data to law enforcement, government agencies, insurance companies, and employers without prior express consent, except when required by court order or subpoena.

• Grants consumers the right to access their genetic data, delete their account and genetic data, and request destruction of biological samples.

• Establishes civil penalties of not less than $2,500 per violation and authorizes the Office of Consumer Protection and Attorney General to enforce the law through civil action.
