S.B. No. 2289 Summary

• Allows direct shipment of beer and distilled spirits by manufacturers holding a general excise tax license and either a Hawaii manufacturing license (Class 1, 14, or 18) or an out-of-state manufacturing license to persons 21 years or older in any Hawaii county for personal use only.

• Requires a valid direct beer and distilled spirits shipper permit obtained from the county liquor commission where beer or distilled spirits is manufactured (or the destination county for out-of-state manufacturers).

• Mandates shipments be in conspicuously labeled containers requiring signature of person 21 or older, with annual reporting to county liquor commissions and payment of all applicable general excise and gallonage taxes.

• Prohibits unlicensed direct shipment of beer and distilled spirits, with violations constituting a misdemeanor.

• Takes effect June 1, 2022, with direct shipping authorized beginning July 1, 2022; requires county liquor commissions to adopt implementing rules without unduly delaying the program start date.
