Office of the governor shall negotiate with Dole Food Company for the State's fee simple acquisition of the Wahiawa irrigation system on Oahu, which provides irrigation water to farmers in Waialua and Haleiwa.

Department of Land and Natural Resources may acquire 15 specified parcels containing the Wahiawa irrigation system; Department of Agriculture may acquire the Wahiawa dam and spillway (TMK 7-1-012-014) from Sustainable Hawaii, LLC; Agribusiness Development Corporation may acquire the associated ditch system.

Department of Agriculture shall repair and maintain the Wahiawa dam and spillway to meet dam safety standards, and DLNR shall not impose administrative fines for safety deficiencies during the State's ownership and maintenance.

Appropriates unspecified amounts from general revenues for fiscal year 2022-2023 to the Department of Agriculture (spillway repairs and acquisition), Agribusiness Development Corporation (management and maintenance), and Department of Land and Natural Resources (management, maintenance, and creation of 4.0 FTE positions).

Act takes effect July 1, 2050; all appropriated moneys unencumbered as of June 30, 2024, shall lapse on that date.
