Beginning July 1, 2022, the Department of Health shall not issue permits for new large capacity underground storage tank systems located mauka (toward the mountains) of the underground injection control line.

Beginning July 1, 2022, no person may operate a large capacity underground storage tank system mauka of the underground injection control line, and existing permits for such systems shall not be renewed.

Exceptions to the prohibition include maintenance necessary to safely support defueling, environmental compliance requirements, operations directly related to defueling, and requirements under section 342L-9.

Large capacity underground storage tank system is defined as any system with a single tank exceeding 50,000 gallons or total tank capacity exceeding 100,000 gallons.

The underground injection control line is defined by specific quadrangles on Department of Health maps for the islands of Hawaii, Kauai, Lanai, Maui, Molokai, and Oahu, effective July 6, 1984.
