Expands eligibility to vacate prostitution-related convictions to include defendants with deferred acceptance of nolo contendere pleas or deferred acceptance of guilty pleas under HRS §853-1

Allows motion to vacate if defendant has not been convicted of any offense under the Hawaii Penal Code within three years after the original deferral date or conviction date

Specifies that the three-year period begins after the deferral of the nolo contendere or guilty plea under §853-1, not the original conviction date

Makes the right to file a motion to vacate applicable retroactively to all previously deferred pleas

Effective date July 30, 2075
