S.B. 2681 - Summary

• Allows bidders on construction contracts to clarify or correct immaterial or technical information in their bids for up to 24 hours after the bid submission deadline, except for changes to the nature and scope of work or substitutions of listed subcontractors.

• Requires that construction bids be opened publicly no sooner than 24 hours after the bid submission deadline.

• Defines "immaterial or technical information" to include arithmetical, typographical, and transposition errors, and minor informalities that do not affect price, quantity, quality, delivery, or contractual conditions such as missing signatures.

• Intended to reduce bid protests and delays by allowing prime contractors time to correct technical errors in subcontractor listings while maintaining bid process integrity.

• Effective July 1, 2050 and repeals July 1, 2024, with section 103D-302 reverting to its prior form upon repeal.
