Adds a new rule to Hawaii Rules of Evidence (Chapter 626, Article VI) authorizing courts to order witness testimony via live two-way video connection in criminal proceedings upon a finding of necessity or with defendant consent.

Requires that testimony taken through video connection must be under oath and viewable by the court, defendant, and trier of fact.

Guarantees attorneys for both the defendant and State the right to be physically present with the witness via live two-way video and ensures full direct cross-examination rights are available.

Effective upon approval and does not affect rights, duties, penalties, or proceedings that existed before the Act's effective date.
