Department of Health must elect to include a state policy in its annual Part C application to the U.S. Department of Education, beginning with federal fiscal year 2022, allowing parents of children with disabilities to continue early intervention services after age 3 until kindergarten entry.

Policy applies to children who are eligible for preschool services under section 619 of the Individuals with Disabilities Education Act and who previously received early intervention services.

Appropriates an unspecified amount from general revenues for fiscal year 2022-2023 to the Department of Health to plan, prepare, and implement the extended Part C option, including potential staff hiring.

Effective date is January 1, 2050.
