S.B. 2801 - Law Enforcement Officers; Duty to Intervene

• Law enforcement officers have a duty to intervene if they reasonably believe another officer is using unnecessary or excessive force on an arrestee, provided intervention can be safely accomplished.

• Intervening officers must report the incident to the offending officer's supervisor as soon as practicable.

• County police department chiefs and relevant department directors must submit annual reports to the legislature by January 31 each year documenting incidents reported under this duty to intervene requirement.

• Annual reports must summarize facts and nature of each reported incident and specify any disciplinary action taken in connection with the incident.

• Law enforcement officer definition includes sheriffs, deputies, police officers, department of land and natural resources enforcement officers, department of transportation harbors division officers, and any other state or county employee carrying a badge and firearm with arrest powers.
