S.B. 2835 - Gender Affirming Treatment Act

• Prohibits health insurance companies from discriminating based on actual or perceived gender identity in policy issuance, coverage, and premiums for individual and group plans.

• Requires insurers to cover gender transition treatments (including hormone therapy, surgeries, and voice therapy) using the same standards as non-transition treatments, and prohibits categorical cosmetic exclusions when the policy covers those services for other purposes.

• Mandates medical necessity determinations for gender transition treatments align with the World Professional Association for Transgender Health Standards of Care, replacing prior standards.

• Requires all health insurance policies to provide clear information to applicants and members about gender transition coverage and appeal procedures for denied claims.

• Effective July 30, 2075, and applies to accident and health policies, hospital and medical service plans, and health maintenance organizations.
