SB2947 Summary

• Establishes a new Agricultural Enterprises chapter authorizing the Department of Agriculture to plan, design, construct, operate, manage, and maintain infrastructure on lands under its jurisdiction to support agriculture.

• Creates a separate agricultural enterprise program allowing the department to accept transfer of agricultural lands and enterprises from the Department of Land and Natural Resources with mutual board approval.

• Permits the department and its lessees to develop agricultural enterprises on public lands, lands acquired through foreclosure, and other approved lands, with lease terms between 15 and 65 years.

• Provides protections for institutional lenders holding security interests in agricultural enterprise leases, including rights to obtain new leases if original leases are canceled for non-monetary violations.

• Takes effect July 1, 2050.
