S.B. 3112 Summary

• Authorizes the Department of Human Services to conduct comprehensive background checks on current and prospective employees, volunteers, contractors, and their employees, agents, or volunteers who work in close proximity to minors, young adults, or vulnerable adults receiving DHS services.

• Requires criminal history record checks under section 846-2.7, consent to obtain other criminal history information, and adult abuse and child abuse/neglect registry checks for covered positions.

• Allows DHS to periodically obtain updated criminal history information through the Hawaii criminal justice data center on all subject individuals.

• Permits DHS to deny or terminate employment or refuse services if background investigation findings indicate the person may pose a risk to the health, safety, security, or well-being of the vulnerable populations served.

• Effective date: July 1, 2060.
