S.B. 3189 Summary

• Elevates promoting gambling in the first degree from a class C felony to a class B felony.

• Elevates promoting gambling in the second degree from a misdemeanor to a class C felony.

• Excludes both promoting gambling offenses (first and second degree) from qualifying for deferred acceptance of guilty plea or nolo contendere plea.

• Adds promoting gambling offenses to the mandatory minimum sentencing provisions under section 706-606.5 for certain felony convictions.

• Effective July 1, 2050.
