SB 369 Summary

• Establishes the time of transfer wastewater system inspection program within the Department of Health to oversee inspection and repair of individual wastewater systems when residential real property is sold or transferred.

• Requires failing individual wastewater systems to be repaired or replaced within one year to meet department design and construction requirements.

• Exempts certain transfers from inspection requirements, including transfers between joint tenants, transfers to spouses/children/parents, and transfers between spouses resulting from divorce or legal separation.

• Removes restrictions on cesspool upgrade options and requires all cesspools to be upgraded or converted to a department-approved wastewater system (rather than only septic or aerobic treatment systems) by January 1, 2050.

• Allows the director of health to grant exemptions from cesspool conversion requirements for properties with documented infeasibility, such as small lot size, steep topography, poor soils, or accessibility issues.
