S.B. 65 Summary

• Allows direct shipment of beer and distilled spirits to consumers by manufacturers holding a general excise tax license and either a Hawaii class 1, 14, or 18 manufacturing license or a valid out-of-state manufacturing license.

• Requires direct beer and distilled spirits shipper permits from county liquor commissions, with out-of-state manufacturers able to obtain permits from any county and in-state manufacturers from their county of manufacture.

• Mandates shipments only to persons 21 years or older for personal use (not resale), with containers labeled "CONTAINS ALCOHOL: SIGNATURE OF PERSON AGE 21 YEARS OR OLDER REQUIRED FOR DELIVERY" and requiring delivery signature verification.

• Requires permittees to report annual shipment volumes to county liquor commissions by January 31, pay all applicable general excise and gallonage taxes, and submit to audits by county liquor commissions.

• Takes effect July 1, 2021, with county liquor commissions required to adopt implementing rules and regulations without delaying the commencement of direct shipments.
