S.B. 767 - Legalization of Cannabis for Personal Use

• Permits adults age 21 and older to possess up to 30 grams of cannabis and grow up to 6 plants (3 mature flowering plants) for personal use without criminal prosecution.

• Allows transfer or sale of up to 30 grams of cannabis between adults age 21 and older without requiring a license.

• Establishes licensing system for cannabis businesses including cultivation facilities, testing facilities, product manufacturing facilities, and retail stores, with application fees capped at $5,000.

• Prohibits cannabis consumption on public highways, sidewalks, federal property, and locations where alcohol is prohibited; restricts packaging and advertising near schools, parks, recreational facilities, and transit areas.

• Removes marijuana from Hawaii's list of hallucinogenic controlled substances and amends drug promotion statutes to exclude licensed cannabis activities; subjects cannabis income to state income taxes and excise taxes.
