SB 788 Summary

• Removes requirement that selection criteria for professional services procurement be ranked in descending order of importance, allowing committees to weigh criteria based on relevance to their agency and project.

• Requires the state procurement office to develop and maintain a past performance database for state contractors by December 31, 2022, including project information, timely completion status, budget data, and cost variances.

• Allows bidders on public works construction projects up to twenty-four hours after the bid submission deadline to clarify or correct non-material or technical issues with subcontractor listings, though additions or substitutions of subcontractors are prohibited.

• Requires construction bids to be publicly opened no sooner than twenty-four hours after the bid submission deadline.

• Effective July 1, 2112, except Part III (past performance database requirements) which takes effect December 31, 2022.
