SB 86 Summary

• Department of Health must issue 8 medical cannabis dispensary licenses to the Department of Hawaiian Home Lands (DHHL): 2 for Honolulu, 3 for Hawaii County (east, north, west), 2 for Maui County (Maui and Molokai), and 1 for Kauai.

• Applicants must be Native Hawaiian, at least 18 years old, with 5+ years Hawaii residency, no felony convictions, and the applying entity must be at least 51% Native Hawaiian-owned with minimum $1,000,000 in financial resources plus $100,000 per retail location.

• Dispensary licenses are non-transferable and no person may hold more than one license.

• Medical cannabis operations on Hawaiian home lands are exempt from county zoning ordinances, rules, and regulations.

• DHHL must study feasibility and revenue potential of medical cannabis dispensaries, limited gaming, and other revenue-generating options on Hawaiian home lands, with report due to legislature by 20 days before the 2022 regular session; effective date July 1, 2050.
