School Facilities Authority must adopt and publish administrative rules implementing Act 72 (Session Laws of Hawaii 2020, as amended) by no later than July 1, 2023, in accordance with chapter 91 of Hawaii Revised Statutes.

Governor must submit a report documenting the School Facilities Authority's processes for purchasing real property and executing capital improvement project contracts to the Legislature no later than twenty days before the 2023 Regular Session convenes.

Act 72 established the School Facilities Agency (renamed School Facilities Authority by Act 217, Session Laws of Hawaii 2021) as a public instrumentality responsible for public school development, planning, and construction related to capital improvement projects.

Currently no administrative rules exist to implement Act 72 as amended, and there is a lack of clarity regarding the Authority's real property purchasing and contract execution processes.
