HB 1034 Summary

• Requires emergency management powers to be consistent with both the United States Constitution and the Hawaii State Constitution.

• Expands the scope of the comprehensive emergency management plan to explicitly include preparation for, mitigation against, response to, and recovery from emergencies and disasters.

• Increases the additional funds available for matching federal disaster relief from $5,000,000 to $10,000,000 and designates these funds as trust moneys under Hawaii Emergency Management Agency control.

• Reduces the duration of price control and tenancy protection measures from ninety-six hours to seventy-two hours following a state of emergency declaration.

• Defines "severe warning" to include notifications from the National Weather Service, Pacific Tsunami Warning Center, United States Geological Survey, and other public authorities regarding coastal inundation, high surf, flash flooding, volcano, tsunami, or hurricane threats.
