HB 1058 Summary

• Amends Hawaii Revised Statutes Section 578-16 to allow adopted individuals to be considered children of both adoptive and natural parents for purposes of determining familial relationships under the Hawaiian Homes Commission Act, 1920.

• Permits adopted individuals and members of their natural family to maintain the same familial relationship and succeed to homestead leases or applications on the Department of Hawaiian Home Lands applicant waiting list.

• Applies only when adoption occurs before the individual reaches age of majority by a spouse of a natural parent, natural grandparent, sibling of natural parent, or their spouses.

• Does not affect other Hawaiian Homes Commission Act requirements or administrative rules beyond recognition of family relationships, and does not create exceptions to termination of natural parent rights in other contexts.

• Takes effect upon approval.
