Repeals section 321-486.3, Hawaii Revised Statutes, which previously imposed penalties of $100 per day for first violations, $500 per day for second violations, and $1,000 per day for third and subsequent violations of unlicensed care home operation.

Directs penalties for unlicensed care home operation to be assessed under section 321-20(1), Hawaii Revised Statutes, allowing up to $1,000 per day regardless of the number of prior violations.

Addresses unlicensed care homes that charge up to $8,000 per month per client by increasing penalty amounts to prevent operators from financially benefiting from unlicensed operation.

Responds to department of health investigations showing 221 alleged unlicensed care homes in the past 48 months with 89 investigations still underway or pending.

Takes effect upon approval.
