Prohibits any person from conducting commercial ocean use activities in Kaneohe Bay waters without a permit issued by the department.

Prohibits advertising or offering commercial ocean use activities in Kaneohe Bay without a permit; advertisement via print, word of mouth, or online platforms (including social media) constitutes prima facie evidence of violation.

Defines "commercial ocean use activity" to include operation of commercial recreational equipment (kayaks, sailboards, tour vessels, etc.), renting or hiring equipment, pre-positioning equipment within 1,000 feet of Kaneohe Bay shoreline, and transporting customers for hire to the bay.

Authorizes law enforcement to issue citations and subpoenas, and to seize property related to violations; confiscated property may be sold at public auction or disposed of if unclaimed after ten working days.

Bans all commercial ocean use activities on Sundays and federal holidays; maintains permit caps and restrictions consistent with the 1992 Kaneohe Bay master plan.
