Amends Hawaii Revised Statutes Section 103D-709(e) to modify the treatment of cash or protest bonds in procurement disputes.

Requires the Department of Commerce and Consumer Affairs to return bonds to the initiating party, minus administrative costs determined by the Office of Administrative Hearings.

Provides for full forfeiture of the bond only if the initiating party does not prevail and the Office of Administrative Hearings finds the appeal was frivolous or made in bad faith; forfeited bonds are deposited into the general fund.

Changes prior law that only returned bonds to prevailing parties, and instead returns bonds to all parties except those with frivolous or bad faith appeals.
