HB1217 Summary

• Prohibits any person from cultivating, producing, manufacturing, distributing, or dispensing cannabis for medical use unless authorized under chapter 329 part IX or chapter 329D.

• Increases the limit on qualifying patients using a single grow site from five to fifty patients, unless the Department of Health grants an exemption.

• Restricts "distribution" of medical cannabis to transfers only from a registered primary caregiver to the qualifying patient, and prohibits caregivers from using a patient's cannabis or accepting it as compensation.

• Requires qualifying patients to obtain medical cannabis from licensed dispensaries or personal cultivation after December 31, 2024, and eliminates exemptions for patients on islands without dispensaries.

• Prohibits the use of butane or other flammable solvents when processing cannabis plants or manufacturing cannabis products, and establishes penalties for mischaracterizing cannabis transactions as other types of compensation.
