HB 1348 - Macadamia Nuts Labeling Requirements

• Amends Section 486-120.5, Hawaii Revised Statutes, to clarify labeling requirements for macadamia nut products containing Hawaii-grown nuts

• Requires that when a package label indicates a portion of macadamia nuts were grown in the State, the country of origin of non-Hawaii grown nuts must be listed on the principal display panel pursuant to the Tariff Act of 1930

• Adds new violation provision prohibiting use of labels that misrepresent or create a reasonable expectation that macadamia nuts are State-grown through use of company names or State imagery, when less than the stated percentage or none were actually grown in Hawaii

• Changes terminology from "Hawaii" to "the State" throughout the statute and updates grammatical references (e.g., "which" to "that", "was" to "were")

• Takes effect June 30, 3000
