HB 1363 Summary

• Extends the deadline for counties to adopt a surcharge on state tax from March 31, 2019, to December 31, 2023, under section 46-16.8(c).

• Authorizes counties with populations of 500,000 or less to use county surcharge revenues for housing infrastructure (water, drainage, sewer, waste disposal, and waste treatment systems), provided developers are not charged for related infrastructure costs.

• Permits counties that previously adopted a surcharge on state tax to amend their ordinances before December 31, 2023, to change the authorized uses of surcharge revenues, including adding housing infrastructure as an eligible use.

• Counties adopting surcharges after December 31, 2022, must use revenues exclusively for housing infrastructure purposes rather than traditional public transportation uses.

• Effective July 1, 2050.
