HB 1502 Summary

• Establishes a permanent news media privilege protecting journalists, newscasters, and digital news website employees from being compelled to disclose sources or unpublished information obtained during news gathering.

• Extends the privilege to non-traditional journalists who can demonstrate by clear and convincing evidence that they regularly participate in reporting news of substantial public interest for dissemination to the general public.

• Exempts the privilege when probable cause exists that the person claiming it committed a crime, when they observed a crime (subject to balancing test), when the source is material to felony prosecution or defamation cases and unavailable through other means, or when disclosure is critical to prevent serious harm to life or public safety.

• Prohibits imposition of fines or imprisonment against persons who refuse to disclose privileged information under this section.

• Takes effect June 30, 3000 (effective date appears to contain a typographical error).
