H.B. 426 Summary

• Establishes a new "Firearm Industry Responsibility" statute requiring firearm industry members to implement reasonable controls to prevent sales to straw purchasers, traffickers, prohibited persons, and those at substantial risk of harming themselves or others.

• Requires firearm industry members to prevent loss or theft of firearm-related products and ensure compliance with federal and state firearms laws.

• Creates a civil cause of action allowing any person harmed in Hawaii to sue firearm industry members for violations, and authorizes the attorney general and county/public prosecutors to bring enforcement actions.

• Establishes a rebuttable presumption that a firearm industry member failed to implement reasonable controls if their actions created a foreseeable risk of harm and they could have prevented or mitigated that risk through reasonable controls.

• Takes effect on July 1, 2023.
