HB 485 Summary

• Allows individuals to obtain new marriage certificates reflecting changed gender, sex identifiers, and names without time restrictions or court orders required under existing law.

• Requires applicants to submit supporting documentation including a new birth certificate, government-issued ID, or affidavit attesting the change conforms to gender identity and is not fraudulent.

• Requires notarized consent letter from non-applicant spouse using specific language stipulating agreement to issuance of new certificate reflecting spouse's legal gender, sex, and name.

• New marriage certificates shall not be marked as amended and shall not reveal original language that was changed, with original certificates sealed and filed with access limited to court order or registrant request.

• Effective January 1, 2024; Department of Health to establish fees for issuance under chapter 91 procedures.
