HB490 Summary

• Establishes paid family leave program providing up to 8 weeks of paid leave to care for a newborn, newly adopted child, or foster child during the first year after placement; and 8 weeks of paid leave annually to care for a family member with a serious health condition.

• Requires family leave benefits to be provided through existing employer-based private insurance system currently used for temporary disability insurance; exempts private employers with fewer than 200 employees from mandatory participation.

• Defines eligible family members as spouse, reciprocal beneficiary, child, parent, sibling, grandparent, or grandchild; and defines "serious health condition" as requiring inpatient care or continuing treatment by a health care provider.

• Repeals chapter 398, Hawaii Revised Statutes (existing paid leave law), consolidating family leave and temporary disability benefits under chapter 392.

• Appropriates funds to the Department of Labor and Industrial Relations to implement the program; provisions effective July 1, 2025 (appropriations effective July 1, 2023).
