State agencies must offer reinstatement with back pay within 90 days to former employees who resigned or were dismissed solely for non-compliance with COVID-19 vaccination or testing requirements.

If the original position is unavailable, agencies must offer an equivalent position with equivalent pay, benefits, and terms of employment, plus back pay based on the former position.

"State agency" includes all executive, legislative, and judicial branch agencies, the Office of Hawaiian Affairs, the Department of Education, and the University of Hawaii.

The Act takes effect upon approval.
