HB 554 - Campus Safety Summary

• Requires University of Hawaii to ensure all individuals implementing the disciplinary process have training or experience in handling sexual misconduct complaints, including trauma-informed and culturally competent training covering effects of trauma, cultural competence, sensitive communication, and impact on individuals with disabilities.

• Mandates the University provide mandatory annual trauma-informed, gender-inclusive, LGBTQ+-inclusive sexual misconduct prevention and awareness programming for all students enrolled at least part-time and employees, covering consent, effects of drugs and alcohol, bystander intervention, and culturally responsive methods.

• Prohibits the University from disciplining reporting parties or witnesses for drug or alcohol use violations when requesting investigation of sexual misconduct, unless the report was determined not made in good faith.

• Prohibits the University from taking disciplinary action against individuals reporting sexual misconduct for non-harassing sexual activity related to the incident or discovered during investigation, and requires review of any disciplinary action against reporting parties to identify links to disclosed sexual misconduct.

• Appropriates funds and establishes 4.0 full-time equivalent positions for the University of Hawaii to implement these requirements, effective June 30, 3000.
