Authorizes the Department of Land and Natural Resources to issue special activity permits to individuals exercising Native Hawaiian traditional and customary fishing practices protected by Hawaii State Constitution Article XII, Section 7

Permits allow take of aquatic life, possession or use of fishing gear, or non-consumptive activities otherwise prohibited by law, subject to Chapter 195D regulations

Clarifies that permits are optional and not required for those exercising constitutionally protected traditional and customary practices, but intended to assist in recognition and protection of such rights

Prevents individuals from being subjected to civil and criminal citation before validating their traditional and customary rights under state law

Takes effect June 30, 3000
