HB 914 Summary

• Removes the requirement for the Department of Health to conduct unannounced visits and inspections of state-licensed special treatment facilities for relicensing or recertification.

• Requires the Department of Health to prioritize investigations of complaints against state-licensed or state-certified care facilities based on the severity of allegations, with highest priority given to allegations of actual or potential harm.

• Expands the prohibition on knowingly referring or transferring patients to unlicensed or uncertified care facilities to apply to any person, corporation, or entity providing health care or human services (previously limited to certified or licensed healthcare providers or facilities).

• Repeals the provision that exempted landlords from being deemed care facility operators when they allow tenants to receive care services from licensed providers without requiring use of those services as a rental condition.

• Effective June 30, 2050.
