SB 1014 Summary

• Allows the Department of Hawaiian Home Lands to retain independent legal counsel when the opposing party in reasonably anticipated litigation is the State or another state agency.

• Requires that legal fees owed to independent counsel retained by the Department of Hawaiian Home Lands shall be paid by the Attorney General.

• Adds the Department of Hawaiian Home Lands as an exception to the general prohibition in Hawaii Revised Statutes Section 28-8.3 preventing state departments from employing or retaining attorneys outside the Attorney General's office.

• Specifies that attorneys employed full-time by the Department of Hawaiian Home Lands under this exception are not required to be Deputy Attorneys General.

• Takes effect on March 22, 2075.
