Expands the definition of "private entity" in public-private partnership law to include businesses with certificates of need or licenses to operate community hospitals or rural hospitals licensed under any state's laws, removing the prior requirement for state health planning agency approval.

Requires the Hawaii Health Systems Corporation Chief Executive Officer (or designee) to provide written comments to the Governor before entering into any new agreement, modifying, or terminating existing agreements to transfer Maui Regional System facilities to private entities, effective January 1, 2024.

Authorizes the Governor to negotiate with private entities to transfer management, operation, and health care service delivery at Maui Regional System facilities (including Maui Memorial Medical Center, Kula Hospital and Clinic, and Lanai Community Hospital) to nonprofit management entities wholly-owned by those private entities.

Upon transfer completion, the State, Hawaii Health Systems Corporation, and the Maui Regional System cease all responsibility for and control over the transferred facilities' management and operation.

Takes effect December 31, 2050.
