• Adds a new section to Chapter 37, Hawaii Revised Statutes authorizing agencies to expend moneys from special funds under their control for capital improvement projects, even if not expressly authorized by the special fund's enabling statute.

• Requires any expenditure on a capital improvement project to be subject to legislative appropriation or authorization.

• Limits agencies to expenditures for capital improvement projects that do not exceed 20 percent of the special fund's ceiling in any fiscal year, unless otherwise authorized by law.

• Defines "agency" as having the same meaning as in section 37-62 of Hawaii Revised Statutes.

• Takes effect upon approval.
