SB 108 Summary

• Adopts the National Instructional Materials Accessibility Standard (NIMAS) for the Department of Education to provide instructional materials to eligible students in accessible formats.

• Defines "eligible student" as a student approved as an "eligible person" under the Copyright Act attending elementary or secondary school, including public schools, private schools, public charter schools, and approved alternative education programs.

• Requires the Department of Education to obtain instructional materials in accessible formats from publishers or the National Instructional Materials Access Center, or to contract with publishers to provide electronic files meeting NIMAS standards.

• Mandates that eligible students receive instructional materials in accessible formats simultaneously with materials provided to non-disabled students, along with any necessary assistive technology devices and services.

• Repeals outdated requirements for publishers to furnish computer diskettes in American Standard Code for Information Interchange format.
