Establishes a new class C felony offense of official misconduct in Chapter 710, Hawaii Revised Statutes, Part II.

A public servant commits official misconduct when they intentionally or knowingly perform an unauthorized act using their office power with intent to obtain a benefit other than lawful compensation.

A public servant commits official misconduct when they intentionally or knowingly refrain from performing an official duty with intent to obtain a benefit other than lawful compensation.

A public servant commits official misconduct when they intentionally or knowingly submit or invite reliance on falsely made, completed, or altered statements, documents, or records in written, printed, or electronic form.

The law takes effect upon approval and does not affect rights, duties, penalties, or proceedings that matured or began before the effective date.
