S.B. 1340 Summary

• Expands exemption from behavior analyst licensing requirements for licensed classroom teachers and teacher preparation program students who implement (but do not design) applied behavior analysis services in schools when working in direct collaboration with a licensed behavior analyst or licensed psychologist.

• Removes the exemption previously granted to direct support workers, requiring them to obtain appropriate licensure or credentials to implement applied behavior analysis services.

• Allows registered behavior technicians credentialed by the Behavior Analyst Certification Board to implement applied behavior analysis services under the direction of either a licensed behavior analyst or a licensed psychologist.

• Permits master's level practitioners and postdoctoral fellows under a licensed psychologist's supervision to provide training and supervision to direct support workers, paraprofessionals, caregivers, parents, and guardians in applied behavior analysis services.

• Effective date: July 1, 2050.
