S.B. 1391 Summary

• Amends Hawaii Revised Statutes Section 171-6.4 to allow the Board of Land and Natural Resources to place a lien on adjoining or abutting private land when a landowner fails to comply with administrative enforcement action for land use violations or unauthorized structures on public lands.

• Establishes that noncompliance with administrative enforcement actions for violations involving structures that fall, slide, or encroach onto public lands (including submerged lands or shoreline areas) shall affect title and create a lien on the adjoining private property.

• Modifies Section 501-151 to expand the definition of "action" to include administrative enforcement actions by state or county agencies, boards, or commissions against landowners for land use violations or unauthorized structures on public lands.

• Modifies Section 634-51 to authorize state and county agencies to record notices of pendency of administrative enforcement actions affecting real property in the bureau of conveyances.

• Takes effect July 1, 2050.
